Dates: These Sweepstakes are valid for the weeks of December 14, 2009 ("Game-Start") through midnight EST December 30, 2009. ("Game-End").
Eligibility: This Sweepstakes is open only to legal residents of Canada and the 50 United States (excluding, without limitation, The District of Columbia, Puerto Rico and other US territories), and who currently reside in the US & Cananda and who are 21 years of age or older at the time of entry. By entering this sweepstakes, participants agree to these Official Rules and to the decisions of the Sponsor, which are final and binding, in all respects. This offer is void where prohibited by law, and subject to all applicable federal, state and local laws and regulations. YOU ARE NOT AUTHORIZED TO PARTICIPATE IN THIS SWEEPSTAKES IF YOU ARE NOT LOCATED WITHIN THE UNITED STATES OR CANADA.
How to Play: In order to qualify for the discounted 12-month Speed Equity® Software and FREE copy if "How to Own Your Homer Years Sooner" Book, entrants must be the first to enter one of the ten (10) DISCOUNT CODES allocated each week into the DISCOUNT CODE field of the subscription form. If a DISCOUNT CODE has already been used, entrant may select and enter any of the remaining DISCOUNT CODES into the DISCOUNT COD field. The Sponsor is not responsible for late, incomplete, garbled, illegible entries, unavailable network connections or transmissions, or problems of any kind, whether mechanical, human or electronic. All entries are the property of Speed Equity®, LLC and no entries will be acknowledged or returned.
Winner Selection: The ten (10) Grand Prizes are allocated to the first ten (10) contestants to use the DISCOUNTED CODES listed on this web page by Game-End. No prize cash equivalents or substitutions will be allowed.
Notification and Awarding of Prize: The winner will know IMMEDIATELY if they have entered one of the UNUSED DISCOUNT CODES if the payment amount shows $49.95 rather than the full retail price of $499. By participation in this Sweepstakes, except where prohibited by law, the winner grants Speed Equity®, LLC the right to use the winners' name, likeness, picture, voice, and written or oral statements, for advertising and promotional purposes worldwide and in any media including but not limited to the world wide web without additional compensation or further notification, permission or consideration. Nothing contained herein shall be deemed to obligate Sponsor to make use of any of the rights granted herein and winner waives any right to inspect or approve any such use of any and every nature and kind.

Disqualification: Speed Equity®, LLC reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or web site; to be acting in violation of the Official Rules; to be acting in violation of the terms of use of the web site by cheating, hacking, deception or other unfair playing practices (including the use of automated entry programs), or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass Sponsor or any other person.
Liability: By entering this sweepstakes or accepting the prize, all participants release, indemnify and hold harmless, including costs and attorneys' fees, Speed Equity®, LLC its affiliates and distributors, successors and their respective, advertising, design, and print production agencies and all their respective shareholders, directors, officers and employees, one and all, from all actions and liability (including attorney's fees and costs) due to injury, loss or damage to person or property, including death, caused in whole or in part, directly or indirectly from the use, misuse, acceptance or possession of the prize, or participation in this sweepstakes. Prize winner waives the right 1) to assert as a cost of winning the prize any and all costs of verification and redemption or travel to redeem said prize, and 2) to any liability claim which might arise from redeeming or seeking to redeem said prize. Sponsor (i) makes no warranty, guarantee or representation of any kind concerning any prize; and (ii) disclaims any implied warranty. If any provision of this Sweepstakes shall be deemed to violate any federal, state or municipal law, it shall be amended to conform to such law and all other provisions shall remain in full force and effect. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS' FEES) FROM ANY SUCH ENTRANT OR PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING SEEKING CRIMINAL PROSECUTION.
Sponsor, prize suppliers, and all production agencies shall not be responsible for technical, pictorial, typographical or editorial errors or omissions in any marketing materials or these Official Rules.
Entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with these Sweepstakes or any prizes awarded and all issues and questions concerning the validity, interpretation and enforceability of these Official Rules shall be subject to the laws of the State of Washington and shall be resolved individually, without resort to any form of class action, and exclusively by MEDIATION. Any controversies or disputes arising out of or relating to these Sweepstakes shall be resolved by binding arbitration in accordance with the then current Commercial Arbitration Rules of the American Arbitration Association. The parties shall endeavor to select a mutually acceptable arbitrator knowledgeable about issues relating to the subject matter of these Sweepstakes. The arbitration shall take place at a mutually agreed upon location in Thurston County in Washington State. The arbitrator(s) shall not have the authority, power, or right to alter, change, modify, amend, add, or subtract from any provision of this Sweepstakes or to award punitive damages. The AGREEMENT to arbitration shall be specifically enforceable under prevailing arbitration law. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes and never shall include consequential, incidental or punitive damages, and in no event attorneys' fees. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you. The award rendered by the arbitrator shall be final and binding on the parties.

Entry in this Sweepstakes grants Speed Equity®, LLC the right to use entrants' information for all legal purposes including giving to marketing partners, Speed Equity®, LLC electronic newsletter subscription. Speed Equity®, LLC will not sell your information to anyone.
